Scope
These General Terms and Conditions (GTC) apply, after their inclusion, to all contracts for the purchase of goods, services, or other items (hereinafter “goods”) in the online shop at the above URL, in the version valid at the time the contract is concluded. These GTC apply exclusively. Any deviating terms and conditions of the customer shall not become part of the contract unless the provider expressly agrees to them.
---
Conclusion of Contract
The offers in the online shop constitute a non-binding invitation by the provider for online shop visitors to submit an offer to purchase the goods offered in the shop.
The order of the goods is placed via the provider’s online order form. After selecting the desired goods, entering all required information, and completing all necessary steps in the ordering process, the customer can order the selected goods by clicking the order button at the end of the checkout page (order). By placing the order, the customer submits a binding contractual offer to purchase the selected goods.
The contract is concluded when the provider accepts the customer’s offer. Acceptance occurs when the provider confirms the conclusion of the contract in written or text form (e.g., by email) (order confirmation) and this confirmation is received by the customer, or when the provider delivers the ordered goods and the goods are received by the customer, or when the provider requests payment (e.g., invoice or credit card payment during the order process) and the payment request is received by the customer. The decisive moment for the contract conclusion is the first occurrence of any of the aforementioned events.
Before submitting the binding order via the online order form, the customer can check and correct their entries at any time using standard input functions such as keyboard, mouse, or touch. Furthermore, all entries are displayed again in a confirmation window before the binding order is submitted and can also be corrected there using the same input functions.
The provider will store the contract text after the conclusion of the contract and send it to the customer in text form (e.g., by email). A further provision of the contract text by the provider does not take place. If the purchase was made via a customer account in the online shop, the customer can view their orders and associated order data there.
The following languages are available for the conclusion of the contract: German, English.
---
Right of Withdrawal for Consumers
Consumers generally have a right of withdrawal for contracts concluded outside business premises and for distance contracts. A consumer is any natural person who concludes a legal transaction for purposes predominantly outside their commercial or self-employed professional activities. Details can be found in the withdrawal policy, which is provided to every consumer no later than immediately before the conclusion of the contract.
---
Payment, Default
The prices listed in the online shop at the time of the order apply. All prices include statutory VAT and any applicable shipping costs. The customer is informed about the available payment methods in the provider’s online shop.
If payment by credit or debit card is agreed, the purchase price becomes due immediately after conclusion of the contract.
If payment via PayPal is agreed, the purchase price becomes due immediately after conclusion of the contract. Payment processing is handled by:
PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg.
If Sofortüberweisung (Klarna Instant Transfer) is agreed, the purchase price becomes due immediately after conclusion of the contract. Payment processing is handled by:
Sofort GmbH, Theresienhöhe 12, 80339 Munich.
If Giropay is agreed, the purchase price becomes due immediately after conclusion of the contract. Payment processing is handled by:
paydirekt GmbH, Stephanstr. 14–16, 60313 Frankfurt am Main.
---
Retention of Title
The purchased goods remain the property of the provider until the purchase price has been paid in full.
---
Delivery and Reservation of Self-Supply
Unless otherwise agreed, delivery takes place within the delivery time stated in the online shop to the delivery address provided by the customer. The applicable delivery times can be found in the online shop.
For freight forwarding deliveries, unless otherwise agreed, delivery is made “free curbside,” meaning to the curb nearest to the stated delivery address.
Self-collection of purchased goods is excluded.
If the provider cannot deliver the ordered goods because the provider was not supplied through no fault of his own despite a timely and congruent cover transaction with a reliable supplier, the provider is released from the obligation to perform and may withdraw from the contract. The provider must inform the customer immediately of the impossibility of performance. Any services already rendered by the customer will be refunded immediately. Mandatory consumer rights remain unaffected.
---
Warranty
The statutory warranty rights apply.
---
Liability
The provider has unlimited liability:
for damages resulting from injury to life, body, or health caused by intentional or negligent breach of duty by the provider or by a legal representative or agent of the provider;
for damages caused by intentional or grossly negligent breach of duty by the provider or by a legal representative or agent of the provider;
based on a guarantee promise, unless otherwise agreed;
under mandatory liability (e.g., according to the Product Liability Act).
If the provider negligently breaches an essential contractual obligation, liability is limited to the foreseeable, contract-typical damage, unless unlimited liability applies according to the above paragraph. Essential contractual obligations are obligations that the contract imposes on the provider and which are necessary for achieving the purpose of the contract, and on whose fulfillment the customer regularly relies.
In all other respects, the liability of the provider, as well as the liability of its agents and legal representatives, is excluded.
---
Data Protection
The provider treats customers’ personal data confidentially and in accordance with statutory data protection regulations. Further details can be found in the provider’s privacy policy.
---
Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless this choice of law results in a consumer with habitual residence in the EU being deprived of mandatory legal provisions of their country of residence.
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the competent court is the court located at the provider’s registered office, unless an exclusive jurisdiction applies. This also applies if the customer has no residence within the European Union. The provider’s registered office can be found in the heading of these GTC.
If any provision of this contract is invalid or unenforceable, the remaining provisions remain unaffected.
